(the “Services”). These Terms and conditions to the Services (the “Terms and Conditions”) govern our provision of the Services to you in connection with, or your use of the Services. “you” shall mean any person and/or group and/or any other who use our Services and/or in any other information in our website, where you are together or alone.
These Terms and Conditions form a legally binding agreement between you and us in relation to your use of the Services. It is important that you take the time to read them carefully. However, if you are not of legal age to form a binding contract with us, or you are a person barred from receiving the services under any applicable laws, then you may not use the Services and may not accept these Terms and Conditions.
We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms and Conditions at any time without further notice. If we do this, we will post changes to these Terms and Conditions, and if you already placed an Order (as defined below), we will send to your email notice with respect to that, and you must approve them again before the use of the Services. You’re continued use of the Services after any such changes constitute your acceptance of the new Terms and Conditions. If you do not agree to abide by these or any future Terms and Conditions, please do not use the Services.
IT IS YOUR RESPONSIBILITY TO REGULARLY REVIEW THESE TERMS AND CONDITIONS.
You understand what self-guided travel involves and agree that you are capable of handling navigation and being responsible for your own use of time during the tour and comfortable with the independent aspect of traveling without a guide, especially in a foreign country.
You acknowledge and understand, that we are not providing a tour guide nor hiking guide, and that we are only a logistic infrastructure provider, inter alia providing mediation between you and different service providers (inns, transport etc.), and different navigating assistant accessories, for your chosen self-guided travel as part of the Services subject to an Order (as defined below).
By using the Services or placing an Order, You represent and warrant that you are at least 18 years old, and if you are under the age of 18, you either have obtained the legal consent of your parent or legal guardian to enter into these Terms and Conditions. By using the Services, You represent and warrant that you have the right, authority and capacity to enter into these Terms and Conditions and to abide by these Terms and Conditions.
- Placing an Order:
Only the Order (as defined below) shall specify the Services to be provided to you.
For booking a Service, you will have to place an order for the specific Service you will choose, thereafter you will receive to your email a quotation for your approval and first payment by you (as further specified below). After your approval, first payment (according to the quotation), and after providing all relevant information required according to the quotation, we will have to process your quotation approval, and only after final order confirmation of the quotation which will be sent to you to your email, the order shall be deemed as booked according to the final order confirmation (the “Order”).
It is hereby clarified, that an Order is not accepted and approved by us until: (a) we acknowledge receipt of your approval and first payment according to the payment terms specified in the quotation, (b) You have accepted these Terms and Conditions, (c) “Israel by Foot” has issued a confirmation to the Order.
- Prices and Payment Terms:
As the quotation is mainly an estimation by us, you understand and acknowledge, that after your approval of the quote during the Order process you may receive a changed order confirmation with different prices and/or accommodations (with respect to accommodations, please see ‘accommodations’ chapter below), in such case, we will request your additional approval of such changed order confirmation, and only in the event you approved the changed order confirmation, this changed order confirmation shall be deemed as the final order confirmation.
As mentioned above, all the payment terms shall be as specified in the Order. It is hereby clarified, in the event you approved the quotation as part of the Order process, but you refused to accept a changed final order confirmation your first payment will be refunded to you.
The ‘Price Wizard’: The price wizard available at our website is a mere assistant tool for you to help you evaluate an optional Order costs. The prices presented at the wizard are not obligatory, and such assistance tool is provided to you for your convenience only.
VAT: The prices specified in the Order are excluded from VAT. According to the applicable law, if required, a VAT will be added to the prices of the Order.
The cancellation terms of the Order shall be as specified in the relevant Order.
- Accommodations and Transportation:
“Israel by Foot” selects accommodations based on their comfort, location, friendliness, and character, and are subject to availability. If the accommodation described is not available or for any other reason according to “Israel by Foot” sole and full discretion, we will provide an alternative with the same standard of comfort (When possible) all as shall be specified in the Order confirmation.
In any event whereby after the confirmation of the Order there shall be changes with the accommodation, for any reason, we shall update you on the new accommodation selected and/or any changes in the final price.
Any additional transportation you desire that is not specifically included in the Order is at your own expense (such as a taxi or bus to accommodations in case of fatigue), or in any case whereby you will change the rout for any reason whatsoever.
It is hereby clarified that our Services do not include transportation to the starting point of the hike nor from the ending point of the hike.
By using our Services, you acknowledge that you and/or any other individual in case you will use the Services/travel/hike as a group of people have made the arrangements for adequate insurance with a reputable insurer to cover personal injury, death, medical expenses, hospital expenses, cost of medicine, rescue expense (Including airborne rescue), repatriation expenses, loss or damage of luggage and belongings, and any expenses associated with cancellation or delay. You are responsible for any loss or damage to personal belongings. In case of illness, all medical fees, including hospitalization, ambulance, medication, doctors’ fees, and repatriation costs, are your sole responsibility and “Israel by Foot” shall not be liable for any such expenses or to refund tour costs or reschedule tour reservations.
By using our Services, you affirm that you are in good health, capable of navigating independently by map and GPS application, physically and mentally capable of engaging in the activity you are booking, and have no known medical issues that would prevent or complicate participation in the activity which is the subject matter hereof.
By using our Services you also affirm that in the event you are going to use the Services and/or to hike together as a group of people, all other participants/hikers/travelers in your group are in good health, physically and mentally capable of engaging in the activity you are booking, and have no known medical issues that would prevent or complicate participation in the activity which is the subject matter hereof.
We accept no liability and pay no compensation when a booking is affected by weather conditions. In case of rain, extreme heat or any other weather conditions that affect the safety and/or enjoyment from the hike.
It is your sole responsibility to assess the weather conditions and to decide if to engage it in the hike and/or place an order.
- Change of plans:
In case you choose not to follow the pre-booked itinerary of the Order due to weather conditions or any other reason, we will make an effort to offer you an alternative plan that suites the situation. Such a change in the plan may involve additional costs. We accept no liability and pay no compensation in such cases.
- Solo Hiking:
We do not recommend solo hiking. It is recommended to always hike at least with an additional one person! You agree and understand that when you choose to enroll in an “Inn to Inn” hike as a solo hiker, you take full responsibility for the additional risk involved due to the fact that you are hiking solo.
- Images Illustrations and information:
The images presented by us at any platform, including our website, are for illustrative purposes only and designed to be a representation of general orientation of the proposed hikes and/or places, and are not in any way designed to represent or guarantee aspects of the hikes and/or places or views from any particular location. Views may be obstructed. Images and views are subject to change without notice and without any liability being incurred by us. The images do not represent a condition that is true at any time.
The information on the hikes and any other instrument and/or toll and/or any other part of the Services provided to you is correct to the best of our knowledge, belief, and understanding at the time of publishing. We accept no liability for any inaccuracy in the information produced. We reserve the right to alter information without notice.
- Force Majeure:
We accept no liability and pay no compensation or any refund when a booking is affected by ‘force majeure’ or Act of God. “Force majeure’ is defined as any event that is beyond our control, which we could not foresee, prevent or avoid, including but not limited to war, threat of war, natural disaster (including flood, earthquake, storm) explosion, sabotage, invasion, terrorist activity, strike, labor dispute, government action, embargo, fire, technical problem with transportation and, without limiting the foregoing, any and all other events beyond our control.
“Israel by Foot” cannot be held responsible for the conditions of trails, roads, footpaths or any other routes included in the tour. These surfaces are maintained by third parties over which we have no control. At all times you participate in the tour at your own risk, and we accept no liability for death, injury, or illness or associated expenses.
- Trail Resources:
Maps, GPS files and route directions provided as part of the Services are for convenience only. We cannot accept responsibility for any inaccuracies of the materials you will receive, which to the best of our knowledge, understanding, and belief were correct at the time of publishing. If you rely on the resources provided to you as aforesaid, you acknowledge that you are doing so at your sole responsibility.
- Phone Support:
Upon arrival to the starting point of the hike you chose according to the Order, you will be presented with the phone number of a local English-speaking contact person available to you in case of an emergency.
Reasons to call include: minor injury or illness (serious injuries must first be reported to emergency medical services), problems with services provided (such as luggage transfer, taxi transfer, etc.) missed transportation connections, or the need to schedule additional services such as further transfers or accommodations. Do not call the emergency contact for basic navigation problems– utilize the included maps, GPS files, and common sense to find your way. This service is only available during daylight walking hours. Accommodations staff are available for other non-emergency matters outside of these hours during reasonable times.
We are not an emergency service. We will always try to answer and solve any issue ASAP. The initial response time to your calls is up to 4 hours during daylight hours. Duration for a final resolution of an issue is unknown and depends on the nature of the situation and the specific circumstances.
- Travel Documents:
You are responsible for obtaining all necessary visas and travel permissions, and for obtaining a passport valid for at least six months beyond your arrival date.
- Traveler responsibility:
Your additional responsibilities as a traveler include, but are not limited to, adhering to local laws, respecting culture and customs, assessing your own abilities, respecting fellow travelers.
- Disclaimer of Warranties:
THE SERVICES ARE PROVIDED TO YOU ON AN “AS-IS” BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, “ISRAEL BY FOOT” EXPRESSLY DISCLAIMS ALL IMPLIED AND STATUTORY WARRANTIES IN RESPECT OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. “ISRAEL BY FOOT” DOES NOT MAKE ANY WARRANTY IN RESPECT OF ANY RESULTS TO BE OBTAINED AS A RESULT OF THE USE OF THE SERVICES. “ISRAEL BY FOOT” DOES NOT GUARANTEE THAT THE SERVICES WILL BE AVAILABLE AT ALL TIMES.
You shall defend, indemnify and hold harmless “Israel by Foot” (and its affiliates) from and against any and all damages, costs, losses, liabilities or expenses (including court costs and attorneys’ fees) which “Israel by Foot” may suffer or incur in connection with any claim, demand, action or other proceeding by any third party arising from or relating to (a) any breach of your obligations, representations or warranties, or (b) your use of the Services, except to the extent the foregoing was caused by intentional misconduct of “Israel by Foot”. If we seek indemnification pursuant to the foregoing we shall provide you with prompt written notice of any indemnifiable claim.
- Limitation of Liability:
IN NO EVENT SHALL “ISRAEL BY FOOT” BE LIABLE TO YOU OR ANY THIRD PARTY FOR (A) ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, DIRECT, SPECIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR RELATING TO THE SERVICES OR ANY OTHER MATTERS CONTEMPLATED HEREIN (INCLUDING NEGLIGENCE) OR (B) ANY AMOUNT EXCEEDING THE AGGREGATE PAYMENTS ACTUALLY RECEIVED FROM YOU. YOU HAVE ALL RESPONSIBILITY FOR ANY DECISIONS MADE AS A RESULT OF ANY USE OF THE SERVICES. THE ABOVE LIMITATION OF LIABILITY DOES NOT APPLY TO DAMAGES ARISING FROM “ISRAEL BY FOOT”’S ACTS OF FRAUD.
WITHOUT DEROGATING FROM THE ABOVE, YOU HEREBY DECLARES THAT HIKING/TRAVELING/USING THE SERVICES AS A GROUP (SUCH AS YOU AND YOUR FAMILY) IS AT YOUR AND YOUR GROUP SOLE RISK AND YOU AND/OR ANY OF YOUR RELATED INDIVIDUALS IN THE GROUP WILL HAVE NO CLAIM AGAINST “ISRAEL BY FOOT” IN THE EVENT WERE DURING THE HIKING/TRAVEL/USING THE SERVICES OR BACK FROM THE HIKING/TRAVE YOU AND/OR YOUR GROUP MEMBERS WILL BE HARM OR INCUR INJURY.
YOU ASSUMES FULL RESPONSIBILITY FOR ANY DAMAGE CAUSED TO YOU AND/OR YOUR GROUP MEMBERS DURING THE HIKING/TRAVELING/USING THE SERVICES, ANYWHERE, INCLUDING BODILY HARM, INJURY, DEATH AND/OR PROPERTY DAMAGE.

These Terms and Conditions are governed by, interpreted and construed in accordance with the laws of the state of Israel. Any disputes regarding these Terms and Conditions will be submitted to the competent court in Tel Aviv, Israel.
